Here’s a glimpse at what IFBB Figure Pro Krissy Chin will be bringing to the stage next weekend. Krissy makes her return to the figure stage after a few months off. Check that. A few months away from the competitive stage but she’s been keeping plenty busy training, hosting a new radio show and working for ALR industries. Krissy tells me she is excited to be back on stage and happy with the improvements she’s made.

Teri Turner & Catherine Holland Two Week Out Preview Photos
Catherine Holland posted a few photos of her killer work out with super trainer Mike Davies on her blog. She also shared a preview of what she’s looking like as she heads into next weekend’s IFBB California Pro. Cat also gives everyone a sneak peak at one of the top NPC Figure competitors, Teri Turner. Teri narrowly missed her pro card a few times last year but has her sights set on finishing business at the NPC JR USA next week. Check back next week to see how these two do at their shows.

2009 NPC Contra Costa Winners
Stacey Oster, from Colorado, won not only the short class but also the overall title at the 2009 NPC Contra Costa Bikini Division. She prevailed over tall class winner, Natalie Pennington for the overall Bikini crown.
In the Figure division, Wendy Fortino won the overall, as well as Class A. Other figure winners include Megan Phi (Class B), Jennifer Aguirre (Class C), and Christy Dalton (Class D). For Master’s Figure, Maria Harvey won the Masters 35+ Overall and the Masters 35+ Short, while Christy Dalton won the Masters 35+ Tall. Barbara Mencer won the Figure Masters 45+ class.

Jessica Lawrence goes from Boxing to Bikini
Jessica Lawerence from Dayton Beach is an amateur boxer with 10 fights under her belt. This six-foot tall blonde decided to hang up the gloves for a bit and try her hand at the NPC bikini. A little encouragement from Rob Rosetti and the Bombshell Fitness crew proved to be all she needed to get on stage and take home top honors at the NPC Eastern Seaboard Bodybuilding & Figure & Bikini Championships. Will we see her take the stage at a national show? Well soon find out but this appears to be yet another solid competitor in the bikini division and a step in the right direction.

Marketing Monday: Kentucky Fried Chicken Gets Grilled
This is a great example of staying true to your brand and not trying to be all to all. Kentucky Fried Chicken (KFC) is know for their FRIED chicken, so when the food chain encouraged consumers to “UNTHINK KFC” you have to wonder why. KFC was asking consumers to think of them as something different with the introduction of their new grilled chicken. Okay, cool a healthy alternative but doesn’t that go against what the very name of your company is?
The marketing people at KFC decided to take things up a notch with their new promotion and enlist the help of Oprah Winfrey. KFC offered a free meal to anyone who downloaded a coupon from the web site, which was announced on Oprah’s show. Sounds great right? Well the folks at KFC weren’t prepared for the number of people who would download and seek to redeem this offer. This turned out to be a marketing and PR nightmare. Yet another lesson in marketing, if you’re going to do something be prepared and also communicate with others involved, in this case the store owners. As ADAGE.com writes…
KFC’s offer sent the chain skyrocketing to the No. 1 topic on Twitter. By Wednesday, blogs began reporting “riots” at New York City KFCs. On Thursday, local news crews interviewed fuming customers getting turned away in other markets, including Chicago. Consumers complained about rude service, and media complained about a PR team that seemed asleep at the wheel. By Friday, the day after KFC pulled the promotion, NPR was calling KFC “the James Frey of fast food,” referring to the author of a memoir praised by Ms. Winfrey that was later exposed as fiction.
There are actually a number of great lessons in this marketing blunder that revolve around one of dieter’s favorite protein sources. Check out the entire ADAGE story and think about it as you attempt to brand yourself and/or your services.

Watson Makes it Three in A Row
Congratulations to Andrea Watson for her third overall NPC figure title. Andrea checked in after the show and let me know, “The third time was a charm”. Andrea has competed in a total of three shows in her life and has won the overall in every one of them. Tonight she took home top honors at 2009 NPC Eastern Seaboard Bodybuilding & Figure & Bikini Championships in Atlatna, GA. Next up for this rising star is the NPC JR USA held in Charleston on May 23rd. Can she make it four in a row and in the process turn pro? She certainly has the potential to do just that.
Dropout to Makeup Queen – Follow Your Passion

Muscle Milk vs Muscle Power – VPX Files Appeal
VPX’s CEO Jack Owoc isn’t backing down just yet. Today, VPX filed an appeal of the injunction that was placed against them regarding their Muscle Power drink. As posted here, a federal judge ruled that Muscle Power’s name and packaging was too similar to CytoSports’s Muscle Milk. The following story appeared on BevNet.com:
VPX filed an appeal Friday of the injunction against its Muscle Power protein drink given to them this week by a federal judge.
The judge ruled that Muscle Power’s name and packaging was too similar to that of Cytosport’s Muscle Milk, the current leader of the fast-growing protein drink market.
VPX CEO Jack Owoc said he was disappointed by the judge’s ruling, which will require the company to remove all Muscle Power product from shelves and dispose of it.

Statement from VPX:
VPX filed an appeal of the injunction issued by a district court in California precluding VPX from using its registered trademark “Muscle Power” and the trade dress on its packaging. Jack Owoc, CEO and founder of VPX, explained that VPX was highly disappointed by the ruling:
“We are very disconcerted by the court’s ruling and think that it was misled in regard to Cytosport’s rights and the nature of the competition in our industry. The only similarities in our trademarks are the use of the word ”Muscle,” but there are more than 60 registered trademarks at the Patent and Trademark Office in class 5 alone containing the word ”Muscle.” ”Muscle” is commonly used in product and company names in our industry, in part because our products help build muscle. Cytosport never objected to the registration of our trademark, despite having an opportunity to do so, and the Patent and Trademark Office found no conflict between “Muscle Power®” and “Muscle Milk®.”
We have never intended to confuse customers into thinking our product was Muscle Milk® – we want them to know it’s different and better! We point out in our advertising why Muscle Power® is a better product — Muscle Milk® contains 600% more sugar and a 183% more fat than Muscle Power®. Muscle Power contains 200% more fiber and 89% less carbohydrates.
We prominently put our VPX logo on the top center panel and, the background, like most VPX products, is the specific 293 Pantone Blue color that consumers have identified as our brand for many years. VPX apologizes to its customers for any disruption this may cause, and we are committed to making our popular Muscle Power® drink available again to our customers and the public as soon as possible.”

Muscle Milk Prevails – Court Orders VPX’s Muscle Power be Removed From Marketplace Immediately
Last week there was a discussion here regarding Muscle Power and Muscle Milk. In my initial post I commented:
VPX also takes a risky move in their package design. The fonts and the packaging itself look very, very similar to Muscle Milk. I understand there are only so many packages that can be used for drinks but the design and look of it has free reign. One can only assume this is an attempt to cause confusion for the consumer. The ad shows the two products side by side and furthers my point.
A Federal Court heard more evidence in a lawsuit filed by CytoSport (makers of Muscle Milk) against VPX (makers of Muscle Power) regarding this very issue. CytoSport Secures Preliminary Court-Ordered Injunction of Muscle Power Due to Infringement of Muscle Milk® Trademark
On Wednesday, May 6th in Sacramento, CA, a Federal Court issued an order requiring Vital Pharmaceuticals, Inc. (VPX) to immediately remove Muscle Power from the marketplace after concluding that the product infringes on CytoSport’s trademark rights of Muscle Milk®.
This preliminary injunction was prompted after CytoSport filed a lawsuit against VPX, stating that Muscle Power’s packaging, or “trade dress,” was deceptively similar to Muscle Milk®’s packaging. In its decision, the court stated that “VPX has chosen an identical font, in an identical color, on an identically shaped package, and placed the mark on the package in an identical location.” The court also stated that “when the marks are viewed as a whole with each product’s respective trade dress, the court has no difficulty concluding that the two marks are overwhelmingly similar.”
Upon concluding that VPX has violated CytoSport’s trademark rights, the court also stated that “VPX could have easily used a trade dress more consistent with its other RTD products, e.g. Redline, Black Pearl and Pump 7.” Given that the injunction is preliminary in nature, the lawsuit will continue while the injunction is in place.
“We are gratified by the court’s ruling and will continue to vigorously enforce our rights to protect our brand, our marketing partners, and our consumers against confusion in the marketplace,” says Greg Pickett, Co-Founder /CEO of CytoSport.
